§1 Seller Information

hereinafter referred to as the “Seller”.

The Customer Service Office is located at the Seller’s registered address.

These Terms & Conditions define the rules for using the Store, placing orders, concluding sales contracts, making returns, and submitting complaints.

These Terms & Conditions are drafted in accordance with the Polish Consumer Rights Act of 30 May 2014, the Polish Civil Code of 23 April 1964, the Act on Provision of Electronic Services of 18 July 2002 and Regulation (EU) 2016/679 (GDPR).

§2 Definitions
Customer means a natural person, legal entity, or organizational unit purchasing products from the Store.
Consumer means a natural person acting for purposes outside their trade, business, or profession.
Entrepreneur with consumer rights means a natural person entering into a contract directly related to their business activity when the contract is not of a professional nature.
Goods means products offered in the Store.
Distance contract means a contract concluded without the simultaneous physical presence of the parties via the online Store.

§3 Technical Requirements
To use the Store, the following are required: a device with internet access, an active e-mail account and an up-to-date web browser.

§4 Placing Orders
Orders can be placed 24 hours a day via the Store’s website.
To place an order, the Customer must add Goods to the shopping cart, complete the order form, accept these Terms & Conditions and complete payment.
The sales contract is concluded upon confirmation of the order by the Seller.
All prices are gross prices including VAT where applicable and are expressed in Polish złoty (PLN) or another currency indicated in the Store.
Delivery costs are indicated before finalizing the order.

§5 Payment Methods
The Store provides the following payment methods: electronic payments including Przelewy24, card payments and other methods available in the Store.
Order processing begins once payment has been credited.

§6 Delivery
Goods are delivered via courier services or logistics operators.
The standard processing time is 2 to 14 business days unless otherwise stated in the product description.
The Seller is not responsible for delays caused by the carrier.

§7 Right of Withdrawal
Consumers residing in the European Union have the right to withdraw from the contract within 14 days without giving any reason.
The withdrawal period expires 14 days after the day on which the Consumer acquires physical possession of the Goods.
To exercise the right of withdrawal, the Consumer must send a clear statement by e-mail to kasialaskowskaart@gmail.com.
The Consumer must return the Goods within 14 days from informing the Seller of the withdrawal.
The Consumer bears the direct cost of returning the Goods.
The Seller will reimburse all payments received including the cost of the least expensive standard delivery option offered within 14 days of receiving the withdrawal notice.
The Seller may withhold reimbursement until the Goods have been received back or proof of return has been provided.
The right of withdrawal does not apply in cases specified in Article 38 of the Consumer Rights Act including goods made to the consumer’s specifications, clearly personalized products and sealed goods which were unsealed after delivery and are not suitable for return for health or hygiene reasons.

§8 Complaints (Non-Conformity of Goods)
The Seller is liable for the conformity of the Goods with the contract in accordance with applicable consumer protection laws.
Complaints should be submitted by e-mail to kasialaskowskaart@gmail.com.
The complaint should include full name, order number, description of the issue and the Customer’s request.
Complaints will be processed within 14 days of receipt.
Failure to respond within 14 days shall be deemed acceptance of the complaint.

§9 Out-of-Court Dispute Resolution
Consumers may use out-of-court methods for handling complaints and pursuing claims.

§10 Personal Data
Personal data is processed in accordance with the Privacy Policy available on the Store’s website.
The data controller is FLORAL MORAL KATARZYNA LASKOWSKA-MOCZKOWSKA.

§11 Intellectual Property
All content, graphics, photographs and artistic works available in the Store are the intellectual property of the Seller.
Any copying, reproduction or use without prior written consent is prohibited.

§12 Final Provisions
Matters not regulated herein shall be governed by Polish law.
Disputes arising from sales contracts shall be resolved by competent courts in accordance with applicable law.
The Seller reserves the right to amend these Terms & Conditions. Amendments do not affect orders placed prior to their effective date.
